New rules on automated hiring

California · In effect

If someone files a discrimination claim, it can matter whether you tested your hiring tools for bias.

California · Jan. 1, 2027

Larger businesses that use software to make hiring decisions will have to tell candidates and assess the risks.

New York City · In effect

Using software to hire for New York City jobs? You need an independent bias audit every year, even if your company is based somewhere else.

Sources are official government sites. General information, not legal advice.

What we look at

  • ✓Are some groups selected less often than others?
  • ✓Are the gaps big enough to matter, or just chance?
  • ✓Where in the process do the gaps show up?

You get a plain-language report. If the law calls for a public summary, we write that too.

If something looks off, it's often a setting, not the whole system: a cut-off score, how much weight one step gets, or a screening question. We'll show you where it is, and if you want help adjusting it, we can do that too.

We can review any step: resume screens, tests, interviews, or software. All we need is de-identified data. One-time audit or regular check-ins, your call.

Why independent?

Results mean more when they come from outside your company. New York City requires an outside auditor. Everywhere else, it just makes the findings easier for others to trust.
